The topic for the November and December months is as follows "Resolved: Judicial Activism is necessary to protect the rights of American Citizens." Here are the points, as follows.
Affirmative: Basic tenet of argument should argue that the Judicial system acts a safeguard of rights. Examples would be Brown v. Board of Education, Miranda v. Arizona and others. Be sure to stress the importance of unbiased guardians whose pwer is not based on the public's ever swaying opinion.
Negative: Basic tenet of the argument should include instances of a biased Judicial system. such examples would include Plessy v. Ferguson, & the Dred Scott Case. Be sure to site the fact that judges are often under little control when they decide matters, due to the fact that their terms are often for life.
Note: Due NOT use Roe v. Wade. Doing so could kill your case if you use it as an argument against your judge's opinion on abortion. This is one of those cases that divides the country so evenly that it too has support and dissent. Avoid at all costs.
